The Agreement

This is a legal agreement between you agreeing to these Terms & Conditions and Kainex. By accepting these terms, making a purchase or using any product provided by us on this website, you declare that you are of legal age and have the authority to make the order.

Kainex is the only applicable licensing entity for all products available for purchase on https://kaine.pl. Our website grants you non-exclusive limited license to use products sold through our website (https://kaine.pl) by Kainex in accordance with these Terms & Conditions issued by our company.

Our products have been designed, implemented and tested in order to meet the personal and business requirements of our customers. We exepect that they will work in most environments. Nevertheless, we cannot and do not guarantee that our products will perform in every environment or be compatible with other extensions, plugins and themes available on market.

1. Definitions.

  • In this document Kainex is also referred to as “us”, “we” or as “seller”.
  • “You” means you, no matter if you are a person or organization along with your employees, agents, heirs or successors. “You” may be also referred to as “customer” or as “buyer”.
  • This agreement may be referred to as the “Agreement” or as the “Terms & Conditions”.
  • All products implemented and provided by Kainex on this website may be referred to as “products” or “our software”.
  • Newer versions of our products are referred to as “Upgrades” or “Updates”.
  • “Support period” is a period of time when a buyer has an access to our support services. It’s length depends on the purchased option.
  • “Order ID” or “Order number” is an unique alpha-numeric 32 characters long text assigned to each order. Order number is known to the buyer and Kainex.

2. Agreement.

By buying, downloading, installing, running and using our software and by using this site you agree to this Agreement. Please do not buy or use our software if you disagree with any of these Terms and Conditions.

3. Product Licensing.

All our products are licensed under the GNU General Public License (http://www.gnu.org/licenses/gpl.html) version 2.0 or later. Nevertheless, this agreement includes additional permissions as defined in Section 7 of the GPL.

The license you purchase grants you access to future upgrades of our software and a customer support for 6, 12 or 18 months (depending on purchased license) from the date of purchase. Once this time passes, you will not be able to download updates of the product or access the support. The product will still function as usual and you are allowed to use it forever, however, we cannot guarantee any future compatibility or protection from possible vulnerabilities in the product code.

4. Product Upgrades.

If you have a valid and active order number as a result of having purchased our product, you will receive upgrades for 6, 12 or 18 months (depending on purchased license) from the date of purchase. Updates will be delivered on demand and you are responsible for installing them. Updates will be available to download through a unique download link sent by e-mail from us to the customer. If you request a refund then you will no longer have access to updates.

5. Customer Support.

If you have a valid and active order number as a result of having purchased our product, you will gain access to our support for 6, 12 or 18 months (depending on purchased license) from the date of purchase. Support services for purchased products are available via our contact form or via direct e-mail messages. If you want to receive our support after your support time period has passed you must purchase a new license. If you request a refund then support time period will end as soon as you receive your money back.

Support requests are handled on a first-come, first-serve basis. We will do our best to resolve issues in a timely and professional manner. However, we make NO WARRANTY, expressed or implied, with respect to our products or with respect to whether the use of our support may resolve any particular issue. The support services purchased from us are sold “AS IS” and WITHOUT ANY WARRANTY. You use our support services at your own risk and we are not responsible for any harm or data loss that might happen as a result of practising our support guides.

We provide support for the following types of issues / inquiries:

  • issues or inquiries related to all features of our products in the version you acquired
  • clarification of existing documentation or products description

We are not able to provide support for use cases or issues derived from the following:

  • storing personal and private information using products installed on your server
  • demands for custom features
  • conflicts with other WordPress plugins
  • conflicts with other WordPress themes
  • conflicts with other 3rd party extensions
  • custom styling of our products

We will not provide support services to our product with altered source code.

6. Refunds.

If you are not able install the product properly on your website or if it fails to perform any of its features as designed, as long as you have worked with our support department to try to resolve these issues, we will consider a refund within the first 10 days of your purchase. All refunds will be granted in the sole discretion of Kainex. All refund requests must include order number and e-mail address. Requests with incomplete or inaccurate information will be disregarded. Refund requests may take up to 7 days to process.

7. Content responsibility.

Kainex disclaims any responsibility for content submitted and published using any of our products. The sole responsibility for the content lies with the buyer.

8. Warranty.

We do not guarantee that our product will function with all 3rd party plugins, extensions, themes or with all web browsers. We are not responsible for any compatibility conflicts that may occur. The software is purchased “AS IS” and WITHOUT ANY WARRANTY. We hereby disclaim any warranty not expressly provided herein. You use our software at your own risk. The entire risk as to the performance and quality of our software is borne by buyer. Kainex is not responsible for any data loss that may occur as a result of installing and running our product.

By purchasing any of our products you indicate that you have read and agree the Terms & Conditions detailed on this page.
